      &lt;span&gt;&#xD;
        
            I rarely talk about my cases, but this is too important. Everyone once in a while, an attorney’s purpose is chosen for them—that the cases choose you and it’s not you choosing the cases. For the greater part of my legal career, I have been fighting the State regarding these bogus Road Home lawsuits that many average homeowners have been suffering.
           &#xD;
      &lt;/span&gt;&#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      &lt;br/&gt;&#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      
           I listened to their truth, I planned, I have fought both in and outside the courtroom, and now the execution of the fruits is finally coming to fruition. These victims are your elderly grandmothers, minorities, those who have served our country and community. Listen to them and their story—their pain and grief of the government who failed them.

  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      &lt;br/&gt;&#xD;

            The Governor, Congressman Troy Carter, Mayor Cantrell, and Secretary of HUD did an amazing job resolving Road Home after eighteen years of pain. I commend them for doing what is right and just.

  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      &lt;br/&gt;&#xD;

           After the horrific storms Katrina and Rita in 2005, the State of Louisiana started the Road Home program to distribute money to homeowners whose homes were affected by the storms. However, now the State is suing them back under the guise that the funds were misused. Recently, Pro-Publica published an article that what has been happening to these victims:

            Now, after the worst of the pandemic, Louisiana Association for Justice (LAJ) was finally able to hold its annual convention in person. LAJ is a voluntary bar association whose statewide membership is composed mostly of lawyers who have a trial practice. Ms. Khan, Mr. Thibodeaux, and Ms. Pierre are all proud members of LAJ.

            We are in unusual times with COVID-19 and have been subjected to a record number of hurricanes this year. As in all unprecedented times, an attorney must consider how prescriptive periods affect the cause of action for which a litigant is suing. One of the first lessons a new attorney generally learns is the importance of determining the prescriptive period of a cause of action. Filing a cause of action too late is fatal.
           &#xD;
      &lt;/span&gt;&#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;br/&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;

           This article aims to illustrate the differences between the applicable prescriptive period in Civil Code art. 3494 and Civil Code art. 3499 when there is a contractual aspect involved, which is sometimes the key to the case.
